Introduction. ZYTO Technologies, Inc. (“ZYTO,” “we,” “our,” or “us”) is committed to protecting your privacy and maintaining the security of your personal information. This Privacy Policy explains how we collect, use, protect, and disclose information when you interact with our website at www.zyto.com, ZYTO software applications, ZYTO hardware devices, including the ZYTO Hand Cradle, communications and support channels, and SMS/MMS text messaging services where applicable. This Privacy Policy applies to information collected online or through our products and services
Device and Software Clarification. ZYTO manufactures and sells both hardware and software products. The ZYTO Hand Cradle is an FDA Class II 510(k)-cleared device for collecting Galvanic Skin Response (GSR) data. ZYTO software is not a medical device and is used to organize and display informational data patterns. ZYTO does not diagnose, treat, cure, or prevent any medical conditions.
Information We Collect.
Information You Provide Voluntarily. Name, email address, phone number, payment and shipping information, practice or business account details for professional users, and support and communication messages.
Device and Software Interaction Data. GSR measurements, session timestamps, workflow steps, and related software interaction data.
Website Technical Data. IP address, browser type, device type, usage analytics, cookie data, and related website interaction data.
SMS Consent, Account Communication, and Participation Data. Phone number, opt-in timestamp, consent source or method, campaign or message category, copy or screenshot of the consent language where applicable, IP address where applicable, messaging preferences, message delivery and interaction records, STOP, HELP, and other opt-out requests, and opt-out history.
How We Use Information.
We use information to: provide and support ZYTO products and services; process orders and manage user accounts; communicate software updates and service changes; provide training, support, and technical assistance; send promotional SMS/MMS messages after the user has provided clear opt-in consent; send account, billing, service, support, transactional, and reminder SMS/MMS messages where permitted by law and related to a customer’s account, subscription, purchase, payment status, license access, or support activity; operate automated or AI-assisted communication tools where permitted by law; maintain consent, opt-out, and compliance records; and comply with applicable legal, regulatory, security, and operational requirements.
SMS Communications.
Promotional and Marketing SMS. If you choose to opt in, we may send recurring promotional, marketing, product update, event, reminder, and informational SMS/MMS messages to the mobile number you provide. Consent to receive promotional or marketing SMS/MMS messages is voluntary and is not required as a condition of purchasing any product or service from ZYTO. We do not automatically enroll users in promotional or marketing SMS programs. Promotional SMS/MMS messages are sent only after the user provides clear opt-in consent.
Account, Billing, Service, and Support SMS. If you are a ZYTO subscriber, customer, user, or account contact, and you provide or maintain a mobile number in connection with your account, subscription, purchase, billing, license, or support activity, ZYTO may send non-marketing SMS/MMS messages related to your account, subscription, billing, payment status, declined payments, credit card updates, license status, service access, support, renewals, security, or other matters necessary to service or maintain your account, where permitted by applicable law.
Message Frequency, Rates, and Carrier Notice. Message frequency may vary depending on the program, your account activity, and the type of communication. Message and data rates may apply according to your mobile carrier plan. Carriers are not liable for delayed or undelivered messages.
Opt-Out and Help Instructions. You may opt out of text messages at any time by replying STOP to any ZYTO text message. ZYTO will also honor other reasonable opt-out requests, including words or phrases such as QUIT, END, CANCEL, UNSUBSCRIBE, OPT OUT, REVOKE, or other language that reasonably communicates that you no longer want to receive text messages. For help, reply HELP to any ZYTO text message or contact support@zyto.com. After you opt out, ZYTO may send one final confirmation message confirming that your opt-out request has been received. No further messages will be sent for the applicable messaging program unless you later provide renewed consent or unless otherwise permitted by applicable law.
SMS Consent Confirmation. We may request or confirm SMS consent through legally permitted methods, including web forms, account settings, email, signed documents, in-person forms, keyword opt-in, or other consent mechanisms. If confirmation is not received where required, promotional SMS/MMS messages will not be sent.
SMS Data Use. We may store your phone number, consent records, opt-in timestamp, consent source or method, messaging preferences, message activity, and opt-out history to maintain compliance, provide support, manage messaging programs, and honor user preferences.
No Third-Party Marketing Sale or Sharing of SMS Data. We do not sell, rent, or share SMS opt-in lists or mobile numbers with third parties for their own marketing purposes. We may share SMS-related information with service providers who help deliver, manage, secure, or support ZYTO’s messaging programs, subject to appropriate contractual restrictions.
AI-Assisted Communications. Some ZYTO communications, including account, billing, service, support, or payment-related calls or text messages, may be initiated, generated, assisted, or delivered in whole or in part by automated systems, AI-assisted technologies, artificial intelligence, or an artificial or prerecorded voice. Where required by applicable law, ZYTO will disclose when you are interacting with an automated or AI-assisted system. You may request to communicate with a live representative by following the instructions provided during the communication or by contacting support@zyto.com.
Data Sharing. We do not sell or rent your data. Information may be shared only with payment processors, shipping carriers, SMS/MMS messaging platforms, telecommunications providers, carriers, aggregators, communication service providers, software and IT service providers, and other service providers required to operate, secure, support, or deliver ZYTO products, services, communications, and messaging programs. Third parties are contractually restricted from using your information for any purpose other than providing services to ZYTO or as otherwise permitted by law.
Data Security. We use administrative, technical, and physical safeguards to protect your information. Sensitive data is encrypted in transit. Access to personal information is restricted to authorized personnel.
Your Rights and Choices. You may request to access the information we store about you, correct inaccurate data, or request deletion where legally permitted. You may opt out of promotional communications at any time. Contact: data@zyto.com.
Changes to This Policy. We may update this Privacy Policy periodically. The “Last Updated” date at the top will reflect any revisions.
